What is the legality of booking a space online?

All bookings made through POP UP SHOPS are legally binding once confirmed. The platform facilitates the agreement between landlord and brand but the contract itself is formed directly between the two parties. POP UP SHOPS acts as the marketplace facilitator and is not a party to the contract.


How contracts are formed


Booking requests

When a brand submits a booking request, they agree to the POP UP SHOPS marketplace terms and conditions. This also covers any additional terms and conditions set by the landlord on the listing.
Once you accept the request, a direct contract is formed between you and the brand. Payment is finalised at the point of acceptance.


Inquiries

In the case of an inquiry, the contract is formed at a later stage. Once you send the brand a booking invitation and the brand accepts and enters their payment details, the two parties enter into a direct contract with one another. Payment is confirmed at this point.


Instant bookings

With instant bookings, the booking is confirmed automatically as soon as the brand submits it. By submitting, the brand agrees to the POP UP SHOPS marketplace terms and conditions as well as any additional landlord terms on the listing. The contract between you and the brand is formed immediately on submission.


What both parties agree to

Before any booking is confirmed, both parties have agreed to the following:

  • POP UP SHOPS marketplace terms and conditions

  • Any additional terms and conditions set by the landlord on the listing

  • Payment terms as outlined at the time of booking


You as the landlord agree to:

  • POP UP SHOPS marketplace terms and conditions

  • The booking details as submitted by the brand

  • The applicable cancellation and refund policies


Important to know

POP UP SHOPS acts as the marketplace facilitator and is not a party to the contract between landlord and brand. All contractual obligations are between the two parties directly.
